Updates to OnlyFans ToS as of September 1, 2024

As of September 1, certain additions to the OnlyFans Terms of Service (TOS) have come into effect.

Let’s take a look at how OnlyFans aims for transparency and safety (according to their statements):

1.Advertising must now be labeled with #ad, #paidpromotion, or #sponsored (this was announced several months ago, sections 18-19).
OnlyFans wants to exert some control over advertising and reduce the likelihood of users being misled.
If you're advertising a product or service, the brand or company name must be included.

2.Any content generated by AI must be labeled with #ai or #AIGenerated (section 19b).
OnlyFans clarifies that AI-generated content includes content created, altered, or enhanced by AI.

Such content can be posted if:
  • The content clearly includes the verified creator (e.g., the face matches the passport).
  • The user can tell that the content was AI-generated or enhanced. So, if a member believes your content is AI-generated, they can file a complaint. Now imagine the reaction of SFS traffic managers after hearing this news 🤣.
  • It is properly labeled and complies with the rules.
OnlyFans is trying to protect itself from potential lawsuits in advance.
3.The terms of OnlyFans can be changed at any time (section 1) and without prior notice, only after the fact (section 4)!

3.1. At any time, OnlyFans may restrict access to any site features or to the site as a whole (section 5).

4.New definitions have been introduced: "Business User," "Consumer," "Creator Earnings" (net revenue after taxes), "Indirect Sales Taxes," "Notice," "Subsidiary," "Tax," and "Upload."

The most important ones for us are:
  • "Business User" – someone who uses OnlyFans for any type of commercial activity, acting either on their own behalf or on behalf of someone else (section 2c).
  • "Consumer" – any user who does not earn money on OnlyFans (section 2g).
  • "Creator" – any user who posts content (section 2e).

So now, we are all business users.
THIS MEANS that OnlyFans officially acknowledges that not only creators can earn money on the platform.

5.Automatic subscription renewal is always enabled, and now members must manually turn it off themselves.
This means it's time to focus on engagement on your page so that members don't disable their rebills.

6. We are legally responsible for any actions that may cause issues for OnlyFans (section 8d).

7.OnlyFans has tightened verification and will request additional documents, which will depend on your place of residence and nationality (section 6b8).

8.You cannot promote your page through Google Ads or any other similar advertising platform, or search engine advertising services (section 17b).

9. Intellectual property rights: by uploading content to OnlyFans, we transfer all rights to that content permanently, non-exclusively, royalty-free, worldwide. Additionally, OnlyFans can transfer these rights to anyone (section 15c).

By using the platform, we waive our moral rights related to our content (section 15d).

You won't even be able to sue OnlyFans for moral damages.

That's not everything, but it's the most interesting part!

Any violation of the rules leads to a warning, and then to a ban.

And the basics:
  • Your content is not confidential.
  • The creator is responsible for everything that happens on the page.
  • Content must be of high quality.
  • All statements/promises to consumers must be detailed and honest (prices, terms, descriptions...).
Still no mention of chargebacks, thanks, OnlyFans!
